Terms and conditions of Purchase - Internet distance selling

• An acknowledgment of receipt of your order will be sent by e-mail immediately after your order has been received.  No contract exists between you and The Gate Studio until The Gate Studio has received and accepted your offer to buy the goods by sending a second e-mail to you.
       
• Your order or our acknowledgment of it is not acceptance of your offer to buy the goods will be sent by e-mail after your order. However we do reserve the right to terminate the contract in the event that the goods are unavailable, mis-priced or payment is not received.    
 
• Should you wish to return goods for any reason you have the right to do so within 7 working days of receiving the goods. The full cost of the goods and the initial postage costs if applicable will be refunded to the original credit/debit card.
       
• Should you wish to exercise your right of cancellation you must give written notice to The Gate Studio. Notification by phone will only be accepted if preceding full written confirmation of cancellation via post or e-mail to the addresses shown in your confirmatory e-mail.
      
• Goods supplied to your own size, design or specification may not be returned. All Driveway timber gates (Butler, Constable, Turner, Lowry, Gainsborough, Rosetti,) are considered to be made to your own specification and requirements irrespective of the size specified by you. Field Gate style designs and Garden Gates are standard items and may be returned.

• Timber Gates may not be returned after they have had holes made into them such as by fitting  hinges and other ironmongery.

• Timber Gates may not be returned after treatment with anything such as but not limited to wood stain, wax, oil or preserver.

• In the case of any suspected defect or damage, please contact us as soon as possible and in all cases before returning goods.
 
• Care of Gates. Incorrect storage of gates can render them irreversibly damaged and make them unfit for use. Gates should be stored in the dry, laid flat or stood vertically, fully supported on all four corners to avoid warping.
 
• Water from rain for example particularly if left to dry naturally will stain timber particularly hardwood.
 
• In the case of returning goods you will be responsible for returning the goods to The Gate Studio at your own cost and expected to take necessary precautions to prevent any damage in transit. If we are notified that you believe the returned goods to be damaged or faulty, upon receiving the goods The Gate Studio will inspect the faults or damage with view to a full refund and reasonable postage reimbursement  where applicable.
       
• The goods must be returned to the correct address, please contact us for confirmation before returning items. With larger items it may be possible for The Gate Studio to collect the goods from you with appropriate arrangements.
       
• Illustrations of products are representations and do not form  part of the contract of purchase.
       
• The Gate Studio do not accept liability for goods being undelivered due to poor accessibility or the buyer being unprepared for delivery of the goods.
       
• Please remember that wood is a natural product and is susceptible to movement and weathering as it seasons. It is not uncommon for some splits to occur as the wood dries out. This is not a fault in the product but a part of using natural products.

• It is expected that the purchaser will with all hardwood gates and softwood gates over 1200mm wide treat the gate/s with a suitable treatment. This should be carried out either before erection or shortly afterwords to slow down the wetting and drying process that occurs when timber is exposed to the elements and sunlight. It is unlikely any claim made for warping twisting or splitting will be successful without being able to demonstrate such a duty of care.
